Since denying the Black populace the vote was contrary to the ratified 15th Amendment to the U.S. Constitution, Segregation in America was UNCONSTITUTIONAL - but a fact of life for millions of African-Americans in the Deep South (and as far north as Washington, D.C.) until southern (Texas) American President Lyndon Johnson defied the "moral values" Segregationists, finally defeated the "Southern filibuster" in the Senate, and ramrodded the Civil Rights Act, and Voting Rights Act, through Congress and the recalcitrant Senate in 1964 and 1965, respectively - two full decades after World War II had shown Americans the gross inequities of the Nazi concentration camps, and at a time that America was staging overt and covert wars (in Vietnam, in Indonesia, in South America, in Africa, and even in Europe) against Communism allegedly to "make the world safe for democracy."
If thousands of America's political, legal, judicial, and 'law' enforcement officials (lawmakers, judges, prosecutors, police, elected officials) were willing to IGNORE the duly ratified Constitution, to CRIMINALIZE an ENTIRE SWATH of American society (blacks and other despised minorities) with oprressive and draconian laws for nearly 100 years after the end of the Civil War - making any violation of the segregation statutes a CRIMINAL OFFENSE (for example, a thirsty black man drinking water from a "WHITES ONLY" water fountain) back then....
...what is to prevent them from doing so again, today???!
answer: ENTIRE LEGIONS of American officials (federal, state, and local government officials and private businessmen) - the same legislators, police, judges, prosecutors whose predecessors supported the brutal, quasi-state applied terrorism of segregation up until 1964 - are today, and HAVE BEEN, CRIMINALIZING entire swaths of American society in the past few decades, starting with the "War on Drugs" and expanding to the long list of infractions which will see just about any local police officer happily slap handcuffs on you, and march you down to the local jail.
And if police at the local level have been getting away with throwing their weight around (if not outrageous conduct or brutality) against citizens at the local level - BACKED UP by prosecutors, judges, and lawmakers all hungry for convictions - then what is to stop officials farther up the power & politics food chain from perpetrating even more draconian atrocities against the people they claim to be protecting?

The former University of Colorado graduate student accused of killing 12 people and wounding 58 others in a shooting rampage at a cinema last week had been under the care of a psychiatrist who was part of a campus threat-assessment team.
The disclosure came in court documents filed yesterday by lawyers for James Holmes, 24, who is accused of opening fire last Friday on a packed showing of the latest Batman movie, "The Dark Knight Rises," in the Denver suburb of Aurora.
The defence attorneys, in their request to an Arapahoe County district judge, are seeking a court order requiring prosecutors to turn over the contents of a package that Holmes sent to Dr. Lynne Fenton and was later seized by investigators.
"Mr. Holmes was a psychiatric patient of Dr. Fenton, and his communications with her are protected," the filing said.
Fenton, medical director for student mental health services at the University of Colorado-Denver Anschutz Medical Campus, provides medication and psychotherapy for grad students in addition to her teaching duties, according to a school website.
A professional biography of Fenton posted on the site said she had conducted research on schizophrenia, including a two-year grant to work in the schizophrenia research department of the US Department of Veterans Affairs from 2008 to 2010. (cont'd)
